1) A hotel, which is 300 metres from the beach at surfer’s paradise, advertises throughout Australia that it is "only a stone throw from the beach". HAs it committed a breach of s 18 of the Australia Consumer Law (ACL). Has it committed a criminal offence under the ACL?
2. A battery manufacture claimed in a advertisement that its batteries ‘lasted up to ten times longer than ordinary carbon batteries’. It is establish that such a claim could be justified in exceptional situations, but that for most common uses, for example in torches and transistor radios, the batteries only lasted two or three times longer than competitive carbon batteries. Has the battery manufacturer breached any laws?
